These Terms & Conditions govern your use of the WildMark platform and describe the rights and responsibilities of both you and WildMark.

Acceptance of Terms
By accessing or using the WildMark platform, you agree to be bound by these Terms & Conditions and all applicable laws and regulations. These Terms apply to all visitors, account holders, subscribers, and other users of the platform.
WildMark's Privacy Policy is incorporated into these Terms by reference and forms part of the agreement between you and WildMark.
If you do not agree with any part of these Terms, you must not access or use WildMark.
Eligibility
To use WildMark, you must:
- Be at least 18 years of age
- Have the legal authority to enter into a binding agreement
- Not be prohibited from using the platform under applicable law
If you are accessing or using WildMark on behalf of a company, trust, partnership, or other entity, you represent that you have the authority to bind that entity to these Terms, and references to “you” include that entity.
By creating an account, you represent and warrant that you meet all eligibility requirements.
Platform Purpose and No Professional Advice
WildMark is a software platform designed to help Texas landowners organize wildlife management records and prepare annual wildlife management documentation, including Form PWD-888 Annual Reports and supporting submission packages.
WildMark is not:
- A law firm, accounting firm, appraisal district, tax adviser, surveying firm, engineering firm, wildlife consulting firm, or government agency
- Affiliated with the Texas Parks and Wildlife Department, the Texas Comptroller of Public Accounts, or any county appraisal district
WildMark does not:
- Provide legal, tax, appraisal, surveying, engineering, biological, or other professional advice
- Determine whether a property qualifies for Wildlife Management Valuation or continued 1-d-1 appraisal
- Guarantee acceptance of Form PWD-888, supporting documentation, or any submission package
- Guarantee any appraisal, valuation, tax, compliance, or government outcome
- File reports with appraisal districts or governmental entities on your behalf unless a separate platform feature expressly states otherwise
Generated reports are organizational and documentation tools only. You are responsible for consulting qualified legal, tax, appraisal, wildlife management, or other professionals when appropriate.
User Responsibilities
You are solely responsible for:
- Entering accurate, complete, and current information into the platform
- Confirming property, acreage, county, wildlife management, and activity records
- Maintaining sufficient supporting documentation for your wildlife management activities
- Reviewing all reports and submission packages before filing with any appraisal district or governmental entity
- Confirming filing deadlines, county-specific requirements, forms, and procedures
- Determining whether your activities satisfy applicable wildlife management requirements
- Consulting qualified legal, tax, appraisal, wildlife management, or other professionals when appropriate
- Maintaining independent copies of important records and completed reports
- Ensuring you have the right to upload all content you submit to the platform
WildMark does not independently verify the truth, accuracy, completeness, legality, or sufficiency of user-provided information.
User Accounts
When you create an account, you are responsible for:
- Maintaining the confidentiality and security of your password
- Providing accurate and current account information
- All activity that occurs under your account
- Promptly notifying WildMark of any suspected unauthorized access to your account
- Keeping your contact and billing information current
Accounts may not be shared beyond authorized users. WildMark may require identity or account verification at its discretion.
Please notify us immediately at support@getwildmark.com if you suspect unauthorized access to your account.
Subscriptions, Billing, Cancellation and Refunds
WildMark may offer monthly and annual subscription plans. Subscriptions may be associated with individual properties. Unless a plan expressly states otherwise, each subscribed property may require its own active subscription. Adding another property may result in an additional subscription charge.
Billing and Renewal
- Subscriptions automatically renew until cancelled.
- Charges occur at the beginning of each billing period.
- You must cancel before the next renewal date to avoid the next charge.
- Cancellation stops future renewal; paid access continues through the end of the current billing period.
- Deleting a property does not automatically cancel its associated subscription unless the platform expressly confirms cancellation.
- Subscription changes, upgrades, downgrades, and proration will be handled as displayed during checkout or account management.
Payment Processing
- Stripe processes payments. WildMark does not store full payment-card details.
- By subscribing, you authorize recurring charges to your selected payment method.
- Applicable taxes may be added where required by law.
- Failed or declined payments may result in retries, limited access, suspension, or termination after reasonable notice.
Pricing Changes
- WildMark may change future pricing with advance notice.
- Price changes do not retroactively change an already-paid billing period.
Refunds: Fees are nonrefundable except where required by applicable law or expressly stated in a published WildMark refund policy. For billing questions, contact support@getwildmark.com.
Acceptable Use
You agree to use WildMark only for lawful purposes. You agree NOT to:
- Upload content you do not have the right to use
- Upload false, deceptive, unlawful, or infringing content
- Upload or transmit malicious software, viruses, or harmful code
- Use automated scraping, bots, or unauthorized data extraction
- Attempt to gain unauthorized access to any part of the platform or its systems
- Circumvent access controls, subscription limits, or security measures
- Interfere with or disrupt the operation of the platform or its servers
- Reverse engineer, decompile, or attempt to extract the source code of the service
- Use the platform to harm, harass, defraud, or impersonate others
- Resell or commercially exploit the platform without written authorization from WildMark
- Use WildMark in a way that unreasonably burdens or disrupts the service
WildMark may investigate suspected violations and suspend or terminate access where reasonably necessary to protect the platform, its users, or third parties.
User Content and Content License
You retain full ownership of all content you submit to WildMark, including:
- Property information
- Field Journal entries
- Wildlife management records
- Photographs
- Maps
- Uploaded documents
- Wildlife census information
- Supporting records
By submitting content, you grant WildMark and its service providers a nonexclusive, worldwide, royalty-free license only as necessary to:
- Host, copy, store, process, transmit, display, format, and back up your content
- Organize your records and generate reports and submission packages on your behalf
- Provide customer support
- Maintain security and prevent abuse
- Comply with legal obligations
WildMark does not claim ownership of your content. You represent that you have all rights needed to upload and use the content you submit. WildMark may remove content that violates these Terms or applicable law.
WildMark will not use your content for unrelated marketing or advertising purposes.
Generated Reports
Completed reports and submission packages are generated from information you provide. You are responsible for reviewing all generated output before use or submission.
You may download, print, copy, retain, and submit reports generated for your own properties.
WildMark owns the underlying software, layouts, templates, and report-generation systems. You may not resell, reproduce, or distribute WildMark's blank templates, software-generated designs, or proprietary platform elements as a competing product.
Important: Generated reports do not guarantee acceptance, compliance, qualification, appraisal treatment, or tax results. You remain solely responsible for confirming that all submitted information is accurate and complete.
Intellectual Property
WildMark and its licensors own all intellectual property rights in the platform, including but not limited to:
- The WildMark brand name, logo, and branding
- Software, code, and platform architecture
- User interface, designs, graphics, and icons
- Marketing content
- Report-generation systems
- Proprietary templates and layouts
Ownership of the WildMark platform does not transfer ownership of your underlying content. No license is granted to you except the limited right to use WildMark in accordance with these Terms.
You may not copy, reproduce, distribute, or create derivative works from any part of the WildMark platform except as expressly permitted in writing by WildMark.
Third-Party Services
WildMark relies on third-party service providers to operate the platform. These may include:
- Stripe — payment processing and subscription billing
- Supabase — authentication, database services, and secure file storage
- Cloudflare — website hosting, DNS, security, and content delivery
- Google Analytics — website analytics and usage reporting
- Transactional email providers
- Other infrastructure, storage, security, or support vendors
Third-party services are governed by their own terms and privacy policies. WildMark is not responsible for independent acts, omissions, outages, or service interruptions caused by third parties to the extent permitted by law.
External links on the platform are provided for convenience and do not constitute endorsement of any third-party product, service, or content.
Platform Availability and Changes
WildMark may, at any time and without prior notice:
- Modify features or add and remove functionality
- Change storage limits or integrations
- Correct errors or perform scheduled or emergency maintenance
- Temporarily interrupt service
- Offer beta or experimental features
- Discontinue features or parts of the platform
WildMark does not guarantee uninterrupted or continuous availability. Beta features may be incomplete, unstable, or changed without notice. WildMark will make reasonable efforts to avoid unnecessary disruption to the service.
Data Storage and Backups
WildMark may store your records and files as part of the service. However, you should not rely on WildMark as your only permanent archive.
You are responsible for downloading and preserving copies of important reports, photos, maps, census records, and supporting documents.
WildMark may use reasonable backup practices but does not guarantee that every file or record can always be recovered. Nonpayment, cancellation, suspension, or termination may eventually result in loss of access to stored data.
Data handling is also governed by the Privacy Policy.
Disclaimer of Warranties
WildMark is provided “As Is” and “As Available” without warranties of any kind, either express or implied. To the fullest extent permitted by law, WildMark disclaims all warranties, including but not limited to warranties of:
- Merchantability
- Fitness for a particular purpose
- Noninfringement
- Accuracy, availability, reliability, or completeness
- Error-free operation
WildMark does not warrant that:
- Reports are complete or error-free
- User information entered into the platform is accurate
- The platform will meet every county-specific requirement
- Any submission will be accepted by an appraisal district or governmental entity
- A property will qualify for or retain a Wildlife Management Valuation or 1-d-1 appraisal
- Any particular tax or appraisal result will occur
No system can guarantee uninterrupted or error-free operation. WildMark makes reasonable efforts to maintain platform availability and reliability but cannot guarantee continuous service.
Limitation of Liability
To the fullest extent permitted by applicable law, WildMark and its officers, directors, employees, contractors, and agents shall not be liable for any:
- Indirect, incidental, special, consequential, exemplary, or punitive damages
- Lost profits, lost revenue, or lost business opportunities
- Loss of data or loss of goodwill
- Cost of substitute services
- Appraisal, tax, filing, or compliance consequences resulting from user-provided information or submitted reports
Aggregate Liability Cap. To the fullest extent permitted by applicable law, WildMark's total aggregate liability arising out of or relating to the platform or these Terms will not exceed the greater of: (a) the amount paid by you to WildMark during the twelve months immediately preceding the event giving rise to the claim; or (b) one hundred U.S. dollars ($100.00).
These limitations apply regardless of the legal theory on which a claim is based and even if WildMark has been advised of the possibility of such damages. These limitations do not apply where prohibited by applicable law.
Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Inlay LLC, WildMark, and their respective officers, employees, contractors, and agents from and against any claims, losses, liabilities, damages, costs, and reasonable legal fees arising from or related to:
- Content you submit to the platform
- False, incomplete, or inaccurate information you provide
- Your unlawful use of the platform
- Your violation of these Terms
- Your infringement of any third-party rights
- Reports or filings submitted using your data
- Your misuse of generated output
This indemnification obligation applies only to the extent your actions or omissions caused the claim and does not extend to claims arising solely from WildMark's own negligence or misconduct.
Suspension and Termination
WildMark may suspend or terminate your access to the platform for reasons including but not limited to:
- Violation of these Terms
- Fraud or abuse
- Illegal activity
- Security threats
- Nonpayment
- Misuse of the platform
- Risk to WildMark, users, or third parties
Serious misuse may result in immediate suspension or termination without prior notice. For ordinary billing issues, WildMark may provide notice and a reasonable opportunity to cure where practical.
You may cancel your subscription and close your account through available account tools or by contacting support@getwildmark.com. After termination, your access may cease immediately. WildMark may delete stored content after a reasonable period, subject to the Privacy Policy and applicable legal retention obligations.
We encourage you to export important records before cancelling or closing your account.
Survival
The following provisions survive termination of these Terms: payment obligations, intellectual property, user content representations, disclaimers, limitation of liability, indemnification, governing law and dispute provisions, and general provisions.
Governing Law, Venue and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
Before filing a formal legal claim, the parties agree to attempt in good faith to resolve the dispute informally by contacting support@getwildmark.com.
Any court proceeding must be brought in the state or federal courts located in the Texas county where Inlay LLC maintains its principal place of business. You consent to personal jurisdiction and venue in those courts.
Note for legal review: The specific Texas county for venue should be confirmed based on Inlay LLC's current principal place of business.
Changes to These Terms
WildMark may update these Terms & Conditions periodically as the platform evolves or as legal requirements change. When we make changes, the updated date at the top of this page will reflect the revision.
WildMark may provide notice of material changes through the platform, by email, or by another reasonable method. Changes generally apply prospectively and will not retroactively alter an already-paid billing period unless required by law.
If you do not agree with revised Terms, you may stop using the platform and cancel your subscription. Continued use of WildMark after the effective date of revised Terms constitutes your acceptance of those changes.
General Provisions
Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and WildMark regarding your use of the platform and supersede all prior agreements or understandings on that subject.
Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
Waiver
WildMark's failure to enforce any provision of these Terms is not a waiver of its right to do so in the future.
Assignment
You may not assign your rights or obligations under these Terms without WildMark's prior written consent. WildMark may assign these Terms in connection with a merger, reorganization, financing, sale of assets, or similar transaction.
Force Majeure
WildMark is not liable for delays or failures caused by events beyond its reasonable control, including natural disasters, utility failures, internet outages, government actions, labor disruptions, or third-party infrastructure failures.
Relationship of the Parties
The parties are independent contractors. These Terms do not create a partnership, agency, fiduciary, employment, or joint-venture relationship between you and WildMark.
No Third-Party Beneficiaries
These Terms do not create rights for any third parties except where expressly stated.
Electronic Communications
By using WildMark, you consent to receive contractual and service-related communications electronically, including by email or through the platform.
